Motorcycle Crash

Our client was riding his motorcycle to work at the Army Reserve Center when a commercial van pulled out of a shopping plaza directly into his path causing him to crash directly into the side of the van. During our investigation, we discovered video of the crash from one of the stores in the plaza. The video showed the van driver eating an ice cream as she drove through the parking lot and stopped at the exit.  As she pulled out, she did not appear to look and did not see the motorcycle coming at her.  Our client could not avoid the crash and hit the side of the van at 30 miles per hour. The van driver did not immediately stop, but when she finally stopped the van, she was parked on our client‘s head and shoulders. Thankfully, he was wearing a helmet, and witnesses told the van driver to get the van off the rider’s head, so she moved it.  Surprisingly, this case was litigated extensively before the insurance company finally decided to resolve the claim.
