Key Takeaways

  • Crucial Video Evidence: Our investigative team secured surveillance footage proving the commercial van driver was distracted (eating) and failed to look before pulling into traffic.
  • Severe Negligence: The at-fault driver not only pulled out directly in front of the motorcycle but also failed to stop immediately after the 30-mph impact, coming to a halt on top of the helmeted rider.
  • Relentless Advocacy: Despite clear video evidence of gross negligence, the insurance company heavily litigated the case before our attorneys ultimately forced them to settle the claim.

Video Evidence Proves Distracted Commercial Van Driver Caused Severe Motorcycle Crash

Our client was riding his motorcycle to work at a local Army Reserve Center when a commercial van abruptly pulled out of a shopping plaza directly into his right of way. Unable to avoid the collision, our client struck the side of the van at 30 mph.

During our independent investigation, we successfully located and secured surveillance video from a nearby store. The footage clearly showed the van driver eating ice cream as she drove through the parking lot and approached the exit. As she pulled out, she failed to look for oncoming traffic and drove directly into the motorcyclist’s path. Compounding her negligence, the driver did not immediately stop after the impact, ultimately parking the van directly on top of our client’s head and shoulders. Fortunately, the client was wearing a helmet, and quick-acting witnesses shouted at the driver to reverse the vehicle off of him.

Despite the irrefutable video evidence of distracted driving and severe negligence, the at-fault driver’s insurance company aggressively fought the claim. Warner & Warner litigated the case extensively, refusing to back down until the insurance company finally agreed to resolve the claim and properly compensate our client.
